INTRODUCTION
Since the legal sale began of CBD Flowers Manufacturers – and therefore customers too – had to pay tobacco duty amounting to 25% of the retail price on all Swiss CBD Products pay which can be smoked. These were even levied retroactively and assertively demanded by the Federal Customs Administration. Although there were already concerns about the legality of these taxes at the time, they had to be paid. That has now changed.
WHAT WAS DECIDED?
As some of you will no doubt have heard in the media, in mid-February 2020 the Federal Supreme Court ruled that the tobacco substitute duty of 25% previously levied on CBD flowers is unlawful. In its judgement, the Federal Supreme Court relies primarily on the characteristic properties of CBD flowers. According to the judgement, these would differ so greatly from those of tobacco that it was unlikely CBD flowers would be used as an actual replacement for tobacco.
According to this judgement, the taxation of CBD flowers as a tobacco substitute product is therefore incorrect and inadmissible. According to the Federal Supreme Court, a new tax must be introduced for CBD flowers. The court leaves open what such a "CBD cannabis tax" could look like.
