INTRODUCTION
Since the legal sale began of CBD Flowers Manufacturers – and therefore customers too – had to pay tobacco duty amounting to 25% of the retail price on all Swiss CBD Products pay for which they can be smoked. These were even levied retrospectively and emphatically demanded by the Federal Directorate of Customs. Although there were doubts about the legality of these taxes even then, they had to be paid. That has now changed.
WHAT WAS DECIDED?
As some of you will no doubt have heard in the media, in mid-February 2020 the Federal Supreme Court ruled that the tobacco substitute tax of 25% previously levied on CBD flowers is unlawful. In its judgement, the Federal Supreme Court based its decision primarily on the Characteristic properties of CBD flowers. These would, according to the ruling, differ so much from those of tobacco that it would be unlikely for CBD flowers to be used as a direct substitute for tobacco.
According to this judgment, the taxation of CBD flowers as a tobacco substitute product is therefore incorrect and inadmissible. In the assessment of the Federal Court, a new tax must be introduced for CBD flowers. The court leaves it open as to what such a «CBD cannabis tax» might look like.
