INTRODUCTION
Seit Beginn des legalen Verkaufs von CBD Flowers mussten Hersteller, und damit auch die Kunden Tabaksteuern von 25% des Verkaufspreises auf alle Swiss CBD Products bezahlen welche sich Rauchen lassen. Diese wurden sogar nachträglich erhoben und mit Nachdruck von der Eidgenössischen Zolldirektion eingefordert. Obwohl es schon damals bedenken über die Rechtmässigkeit dieser Steuern gab musste Sie bezahlt werden. Das hat sich nun geändert.
WHAT WAS DECIDED?
Wie einige von Ihnen sicherlich aus den Medien mitgekriegt haben, entschied das Bundesgericht mitte Februar 2020, dass die bis anhin auf CBD Blüten erhobene Tabakersatzsteuer von 25% unrechtmässig ist. Im Urteil stützt sich das Bundesgericht hauptsächlich auf die charakteristischen Eigenschaften von CBD Blüten. Diese würden sich gemäss dem Urteil so stark von jenen von Tabak unterscheiden, dass es unwahrscheinlich sei, dass CBD Blüten als eigentlicher Ersatz für Tabak verwendet werde.
According to this judgement, the taxation of CBD flowers as a tobacco substitute product is therefore incorrect and inadmissible. According to the Federal Supreme Court, a new tax must be introduced for CBD flowers. The court leaves open what such a "CBD cannabis tax" could look like.

Although there are no official statements on the Federal Court's judgement, it appears that the tobacco tax on CBD flowers will indeed be cancelled without replacement for the time being.
